Terms and Conditions
§ 1 Scope and General Information
Subject to individual agreements with you, which take precedence over these Terms and Conditions, the following Terms and Conditions apply exclusively to the business relationship between you and us. We do not recognize any conflicting or deviating terms from you unless we have expressly agreed to their validity in writing.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.
§ 2 Conclusion of Contract
All our offers are non-binding and without obligation and constitute merely an invitation for you to submit an offer to purchase. You submit a binding offer to AMAZONEN-WERKE H. DREYER SE & Co. KG when you complete the online ordering process by providing the required information and clicking the “Submit Order” button in step 5. Upon receipt of your order, you will initially receive an order confirmation, usually via email, confirming receipt and detailing the order (acknowledgment of receipt). This does not yet constitute acceptance of the order by us. After receiving the order, we will review it promptly and inform you within two business days via an order confirmation whether we accept your order. The contract is concluded with the AMAZONE Online Fan Shop unless explicitly stated otherwise.

§ 3 Prices and Delivery Conditions
Prices applicable at the time of the order apply. All prices are in EURO and include the applicable German VAT.
Packaging and shipping costs are charged separately and are shown in the order form. These costs are borne by you. Orders over EUR 50.00 are delivered free of charge.
Delivery is made by postal service. If insured shipping is requested, this must be indicated in the order form. Any resulting additional costs are specified in the order form and must be borne by you.
Partial deliveries are permitted if reasonable for you. This applies in particular if:

the partial delivery can be used for the intended contractual purpose,
-
delivery of the remaining items is ensured within the agreed delivery period, and
-
no significant additional effort or costs arise for you (unless we agree to cover these costs).
In the case of partial deliveries, you pay only the shipping costs for the first delivery. If partial deliveries are made at your request, you bear the shipping costs for all individual deliveries.
§ 4 Storage of Your Order Data
Your order data is stored by us. If you wish to have it in printed form, you can print the “Order Confirmation” that appears on your screen after submitting the order. If you have provided your email address, you will also receive all relevant order data by email, which can also be printed.
§ 5 Payment Terms
Payment can be made by VISA/MC credit card, SofortĂĽberweisung, PayPal, cash on delivery, or prepayment. We reserve the right to exclude certain payment methods in individual cases or to require prepayment.
Payment of the purchase price is due immediately upon conclusion of the contract. If the due date is calendar-based, you are in default by missing this date. In such a case, you must pay default interest of 5 percentage points above the base rate.
Your obligation to pay default interest does not exclude our right to claim further damages caused by delay.
You may only offset claims that have been legally established, undisputed by us, or acknowledged by us in writing. You may only exercise a right of retention if the underlying claims arise from the same contractual relationship.
§ 6 Retention of Title
The delivered goods remain our property until full payment is received.
§ 7 Warranty
We are liable for material defects in accordance with the applicable statutory provisions.
A warranty for the items delivered by us exists only if expressly provided by us in the order confirmation.
§ 8 Liability
Your claims for damages are excluded. This does not apply to claims arising from injury to life, body, or health or from the breach of essential contractual obligations, nor for other damages resulting from intentional or grossly negligent breaches by us, our legal representatives, or agents. Essential contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on which you may rely. In case of a negligent breach of an essential contractual obligation, our liability is limited to foreseeable, typical damages.
The provisions of the Product Liability Act remain unaffected.
§ 10 Consumer Arbitration
We are generally willing to participate in dispute resolution procedures before a consumer arbitration board.

§ 12 Our Security Standards
We value your trust and apply the utmost care and highest security standards to protect your personal data from unauthorized access. Your order, personal data, and payment information are protected by technical security systems and additional authorization procedures during both transfer and storage on our servers. Data transfer uses SSL (Secure Socket Layer) with 256-bit encryption, a system also used by banks for online banking. You recognize encrypted transmission by the closed display of a key or lock icon in your browser’s status bar. The connection is encrypted with AES-256, and the key exchange uses RSA 1024-bit.
§ 13 Payment Security
All payment methods are fully protected by the above security standards. For credit card payments, additional security is provided through the request of the card verification number (CVV) during the ordering process. The three-digit code is located on the signature field on the back of your credit card.
§ 14 Miscellaneous
German law applies to the exclusion of conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a merchant, a legal entity under public law, or a public-law special fund, the court of jurisdiction for all disputes arising from contractual relationships between you and us is 49205 Hasbergen.
